General terms and conditions of delivery Rusch Mineralen Webshop B.V.

These conditions are valid on the online shop or webshop of Rusch Minerals.
Rusch Mineralen Webshop B.V. is part of Rusch Mineralen B.V.

Article 1. Applicability

1. The general terms of delivery apply to all orders and offers of Rusch Mineralen Webshop B.V. (hereinafter referred to as RMW).
2. It is only possible to deviate from the applicability of these general terms and conditions in writing.
3. Accepting an offer or placing an order implies that you accept the applicability of these terms and conditions.

Article 2. Quotations and offers

1. All our quotations and offers are without obligation and are made subject to availability. RMW expressly reserves the right to change prices if (legal) regulations make this necessary.
2. An agreement is only established when RMW has sent an order confirmation by e-mail, in the case of the web shop.
3. RMW may refuse your order without any liability for damages, in which case RMW will notify you as soon as possible.
4. A contract is concluded when an order confirmation is handed over to the buyer by e-mail.

Article 3. Prices and payments

1. The prices stated for the products and services offered are in euros, excluding VAT.
2. Payment of the order is made by iDEAL or bank transfer, in both cases the processing of this payment is outsourced to Buckaroo.
3. If agreed, payment can be made by invoice payment to IBAN: NL65 RABO 0384 5650 85 in the name of Rusch Mineralen Webshop B.V., quoting the invoice number. The order will be sent upon receipt of payment.
4. In case of prepayment by bank, the buyer has 3 days from the order date to transfer the invoice amount due. If the buyer does not pay within 3 days, RMW has the right to cancel the order without notifying the buyer.
5. Shipping costs in the Netherlands are charged at €6.58 excluding VAT per parcel of 23 kg as standard. Shipments over 100 kg are sent by pallet. Prices for this are on request and will be communicated before shipment.
6. For orders with a delivery address outside the Netherlands, different shipping costs apply.
7. Orders with an invoice amount above €300 excluding VAT and under 23 kg will be delivered in the Netherlands without shipping costs.
8. RMW Maintains a minimum order amount of €150.- excluding VAT.

Article 4. Delivery

1. Whenever possible, ordered products are shipped within 2 to 3 working days after receipt of order with the exception of holidays, buying trips or illness.
2. The stated delivery time is indicative, the buyer cannot derive any rights from it.
3. Should products not be in stock, the delivery time may be deviated from, this will always be done in consultation with the customer.
4. If RMW is unable to deliver the items, it will at all times refund to the customer any amount paid in advance for the item in question.
5. Products will be delivered upon receipt of payment, this may be deviated from by agreement.

Article 5. Retention of title

1. After full payment, the product is the property of the buyer. The risk in respect of the products shall pass to the buyer already at the time of delivery

Article 6. Liability

1. Upon delivery of the goods, the customer is obliged to examine whether they comply with the agreement. If they do not, you must inform RMW as soon as possible, in any case within 3 working days.
   
   
2. If the goods delivered to you do not meet expectations, please contact RMW by telephone. Return of products and/or orders will only take place by mutual agreement. Returned goods will only be refunded if they are unused and returned in their original packaging. The return shipment must be sufficiently stamped by you. The purchase amount will be credited within 14 days and, if necessary, returned to the account from which it came. The cost of the return shipment will not be reimbursed by RMW.

Article 7. Communication

1. RMW shall not be liable for misunderstandings, mutilation, delays or improper transmission of orders and notifications resulting from the use of internet or any other means of communication in the traffic between the customer and RMW or between RMW and third parties insofar as they relate to the relationship between the customer and RMW, unless and insofar as there has been intent or gross negligence on the part of RMW.

Article 8. Intellectual and industrial property rights

1. Buyer shall fully and unconditionally respect all intellectual and industrial property rights vested in products delivered by RMW.
2. RMW does not guarantee that the products delivered to the buyer do not infringe any (unwritten) intellectual and/or industrial property right of third parties.

Article 9. Personal data

1. RMW respects the privacy of all buyers. RMW uses the buyer's data exclusively for handling the order. All buyer data is stored by us in compliance with the provisions of the Personal Data Protection Act (WBP).
2. All your personal data can be requested, corrected, withdrawn or deleted free of charge at any time
3. RMW will not pass on your details, including address and e-mail address, to third parties without the buyer's express consent.

Article 10. Force majeure

1. Without prejudice to its other rights, RMW shall, in the event of force majeure, be entitled, at its own discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention, by informing you of this in writing and without any form of compensation.
2. Force majeure shall mean any shortcoming that cannot be attributed to RMW, because it is not due to its fault and neither by virtue of law, legal act or generally accepted practice.

Article 11. Applicable law and competent court

1. Dutch law applies exclusively to all rights, obligations, offers, orders and agreements to which these Conditions apply, as well as to these Conditions. All disputes between the parties shall exclusively be submitted to the competent court in the Netherlands.
